Under Pennsylvania’s DUI statute, driving under the influence of alcohol is charged as a misdemeanor. Each offense raises the level of penalty assessed. For example, based upon your blood alcohol content a first offense has a mandatory minimum sentence of 72 hours in jail. A second offense with the same blood alcohol content has a mandatory minimum sentence of 90 days in jail. A third offense with the same blood alcohol content has a one year sentence which would be served in a state correctional facility.
